Consumer Ordering Terms
When you place an order on a restaurant website powered by Vendo, your contract is with that restaurant, not with Vendo. This page explains where Vendo’s role ends and the restaurant’s begins.
1. What Vendo is
Vendo is the technology platform that powers the restaurant's online ordering system, point-of-sale terminal, kitchen display, and website. Vendo is a software provider. Vendo does not prepare, cook, package, or deliver food. Vendo does not employ the restaurant's staff. Vendo does not set menu prices, hours, or delivery zones.
2. Who you are buying from
When you place an order on a Vendo-powered site, your contract is with the restaurant, not with Vendo. The restaurant is the seller. Vendo facilitates the transaction through software.
3. Orders
- Menu items, descriptions, prices, and availability are set by the restaurant and can change without notice.
- Submitting an order constitutes an offer to purchase from the restaurant.
- The restaurant may accept or reject any order at its discretion.
- An on-screen confirmation does not guarantee that every item is available. The restaurant may contact you to substitute or cancel items.
4. Pricing and payment
- All prices, including item prices, taxes, and any service fees, are set by the restaurant.
- Payment is processed by Stripe. Stripe handles your card details directly. Vendo does not see or store your card number.
- Applicable taxes are calculated and collected as required by the jurisdictions the restaurant operates in.
- Tips, if offered, go to the restaurant and its staff.
5. Allergies and dietary restrictions
Menu information — including ingredients, preparation methods, and allergen disclosures — is provided by the restaurant. If you have a food allergy or dietary restriction, contact the restaurant directly before ordering. Vendo does not verify the accuracy of allergen information and is not liable for allergic reactions or other adverse health effects.
6. Delivery and pickup
- The restaurant handles delivery and pickup operations directly. Vendo does not employ drivers or operate a delivery fleet.
- Estimated ready times and delivery times come from the restaurant and are not guarantees.
- Vendo is not responsible for late deliveries, missing items, incorrect orders, food temperature, or any other delivery-related issue. Contact the restaurant.
7. Refunds and disputes
- Refund and cancellation policies are set by each restaurant. Read the restaurant's policy before ordering.
- To request a refund or dispute an order, contact the restaurant directly.
- Vendo may help relay communication between you and the restaurant but is not a party to the dispute.
- Vendo does not issue refunds for food orders. Only the restaurant can.
8. Your account and data
- Order information you enter is stored in the restaurant's Vendo account. For your data, the restaurant is the data controller and Vendo is the data processor.
- See the Privacy Policy for how Vendo handles your data on the restaurant's behalf.
- You may request deletion of your data by contacting the restaurant or emailing legal@vendo.pizza.
9. Acceptable use
- Use accurate name, contact, and delivery information.
- Do not place fraudulent orders.
- Do not abuse, harass, or threaten restaurant staff through the platform.
- Vendo may suspend access for violations and report fraudulent orders to the affected restaurant and to law enforcement where appropriate.
10. Limitation of liability
- Vendo's liability is limited to the technology platform itself.
- Vendo is not liable for food quality, food safety, order accuracy, delivery performance, restaurant conduct, health-related claims, or any dispute between you and the restaurant.
- To the fullest extent permitted by applicable law, Vendo disclaims all liability for damages arising from food orders placed through the platform.
